Historical legal review and product status
Private counsel opinions dated April 16, 2010 (Christine M. Humphrey) and June 3, 2020 (Michael J. O’Flaherty) address food and dietary supplement pathways for shark cartilage and crocodile peptides. They are conditional historical advice, not opinions issued by the FDA.
The 2010 opinion supported marketing subject to its assumptions and labeling requirements. The 2020 update identified additional ingredient requirements, including likely NDI notification for crocodile peptides in supplements or a supported GRAS determination for food use. The applicable pathway for the current formula remains to be confirmed.
